Terms & Conditions

1. About us and these Terms

Amberly Learning is operated by Amberly Learning Ltd, company number 17432167, registered at 48 Queen Street, Exeter, EX4 3SR, United Kingdom. Contact us at hello@amberlylearning.com.

These Terms govern use of Amberly Learning and purchases of Amberly+. Please read them before creating an account or buying access. Our Privacy & Cookies Policy separately explains how we handle personal information. Nothing in these Terms removes rights you have under applicable consumer law.

2. Our learning service

Amberly provides English-learning resources, including graded reading and audio, a placement test, grammar practice, vocabulary and flashcards, dictation, games, Real-Life conversations and teacher resources. Some resources are free; others require an account or Amberly+.

The membership page and checkout describe the features and access included in your selected package. A purchase gives you permission to access and use the included resources under these Terms, not ownership of the resources. We do not promise that every free feature will remain available permanently.

3. Accounts and security

Provide accurate registration information and keep your login credentials secure. Accounts are for individual use; do not share access with unrelated users or misrepresent someone else's identity. This does not prevent permitted classroom use described below.

Tell us promptly if you suspect unauthorised account use. We may take proportionate security measures. You are not responsible for an unauthorised use simply because it involved your account where the loss was caused by our own breach or security failure.

4. Younger learners

Our educational resources may be useful to learners of different ages. Younger users should review these Terms with a parent or guardian where appropriate. Where applicable law requires parental permission or supervision, it must be provided.

A paid package must be purchased by someone legally able to enter into the payment contract. A parent or guardian may need to arrange and manage payment for a younger learner. We do not represent that every user under 18 must consent to all data processing through a parent.

5. Packages, prices and payment

Amberly+ may be offered as a recurring subscription or a one-off time-limited access package. Available durations, features, currency and prices are those displayed for your location at the time of purchase; not every package is available in every region.

Review the total payable, billing period and any applicable taxes displayed at checkout before paying. Where tax applies, the checkout total determines the amount charged; we do not promise that every advertised price has identical tax treatment in every country.

Payments are handled through Stripe's hosted checkout. Amberly does not store complete payment-card numbers. We receive subscription, transaction and billing information needed to administer purchases. Your bank or payment provider may apply its own currency-conversion charges.

6. Renewal and one-off access

Recurring subscriptions automatically renew at the billing interval shown at purchase until cancelled. Buying a recurring subscription authorises the corresponding recurring payments. Your account and billing portal provide subscription-management information.

One-off day packages do not automatically renew. Their access expires when the purchased period ends. Purchasing another package extends access according to the period shown for that purchase.

Complimentary access and promotions may have their own stated duration and conditions. They do not imply a paid subscription or an indefinite right to premium access.

7. Failed payments

A failed or incomplete payment may prevent access from starting or continuing. Payment retries and billing messages may be handled by Stripe. Premium access depends on the recorded payment and subscription status; we do not promise a fixed grace period.

If you believe a payment succeeded but access is missing, contact us so we can investigate. Do not share complete card details with us.

8. Cancelling a subscription

Use the subscription-management control in your Amberly+ account to open the billing portal and manage or cancel your subscription. If you cannot use it, contact hello@amberlylearning.com for help. Review the effective date shown in the portal.

For a cancellation scheduled for the end of the paid billing period, access continues until that date and the subscription will not renew. Immediate cancellation, a refund or a payment-status change can have a different effective date; the actual confirmation will explain what applies.

Cancelling a subscription does not itself delete your Amberly account. A one-off package has no recurring renewal to cancel.

9. Statutory cancellation rights and refunds

You may have a statutory right to cancel a distance purchase, including a 14-day cancellation period where applicable. Contact hello@amberlylearning.com to exercise a cancellation right, identifying the purchase and stating clearly that you wish to cancel. You do not have to use a particular form.

Starting to use Amberly+ does not, by itself, mean you lose statutory cancellation rights. Any lawful treatment of immediate digital supply depends on the type of supply, the information provided and any express request or acknowledgement required by law. These Terms are not a blanket waiver.

Outside statutory cancellation rights, stopping use or cancelling a renewal does not automatically entitle you to a partial refund for unused time. This does not affect remedies for faulty or misdescribed content or services, our failure to supply what you purchased, or any other mandatory right. Contact us about refunds or access problems; requests are considered against the circumstances and applicable law.

10. Price and service changes

We may change prices for future purchases. Changes affecting an existing recurring subscription will be communicated appropriately before they apply, with any cancellation or consent rights required by law. We will not impose an undisclosed retrospective price increase.

We may improve, correct or retire resources and change features. Material reductions to an existing paid service will be handled fairly, including appropriate notice and remedies where required. This is not an unrestricted right to remove paid access while keeping payment.

11. Educational guidance and exam references

Our resources, CEFR levels, placement results and progress indicators support learning and self-study. They are educational guidance, not an accredited qualification or a guarantee of a particular examination result, admission, job or rate of progress.

We take reasonable care with the service, but educational material can contain errors. Tell us if you find one. This does not exclude our obligations to provide paid content and services as required by consumer law.

IELTS-style exercises are independent practice materials, not official IELTS tests. Amberly Learning is not affiliated with or endorsed by IELTS. References to examination systems and CEFR do not imply certification or endorsement.

12. Content ownership

Amberly Learning content belongs to Amberly Learning Ltd. This includes our articles, explanations, exercises, teaching materials, audio, images, illustrations, branding and site materials. Any identified third-party material remains subject to its owner's rights.

Copyright and other applicable intellectual-property rights are reserved except for the permissions below or any separate permission we give in writing.

13. Personal learning use

You may use resources you are authorised to access for your own learning, take notes, complete activities, and print or download resources where the site provides that option. Normal browser caching and technically necessary copies are permitted.

Do not republish, sell or distribute the resource collection, remove ownership notices, evade paid access controls or use our materials to create a substitute resource library.

14. Teachers and classroom resources

Teachers with authorised access may use resources identified as teaching or classroom materials with students they personally teach, including displaying them and making reasonable copies for those lessons. This permission does not give students or colleagues a shared premium login.

Do not publish premium worksheets or downloads openly, resell them, upload a standalone collection to a file-sharing service, or distribute our premium library to other teachers or organisations. Ask us before school-wide, multi-user or other redistribution beyond ordinary authorised classroom use.

Resource-specific permissions or a separate written licence take priority. If you need confirmation about continued classroom use of downloads after membership ends, contact us; these Terms do not grant an unrestricted perpetual redistribution licence.

15. Acceptable use and automated access

Do not attempt unauthorised access, interfere with the platform, introduce malware, misuse another person's information, commit fraud or evade authentication and subscription controls.

Do not bulk-scrape, mirror or systematically extract our resource library, impose unreasonable automated load, or harvest it for a competing service or commercial training dataset without permission. This does not prohibit ordinary search-engine indexing we allow or lawful personal learning use.

16. Availability and account restrictions

Maintenance, faults, security work and circumstances outside reasonable control can interrupt service. We do not guarantee uninterrupted availability. Contact us if a fault materially affects paid access so we can investigate and provide an appropriate remedy.

We may proportionately restrict or suspend access for serious or repeated misuse, fraud, security risks or unlawful activity. Where appropriate we will explain the issue and allow an opportunity to address it. Any termination remains subject to applicable refund and consumer rights.

17. Deleting your account

Contact hello@amberlylearning.com to request account deletion or for help with any available account-deletion control. Deletion and subscription cancellation are different operations: follow the subscription instructions and any warnings shown before deletion, and contact us if you need help confirming that future billing has stopped.

Deletion removes access to the account and its saved learning information, subject to the cleanup process and records that must reasonably be retained. It does not automatically refund earlier purchases. The Privacy & Cookies Policy explains deletion and retention in more detail.

18. Providers and external links

We use service providers for functions including hosting, authentication, payments, email and media delivery. Their involvement does not remove Amberly's own obligations to you.

External websites linked from Amberly are independently operated and have their own policies and terms. A link is not a general endorsement of everything on that website.

19. Responsibility and your legal rights

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.

For consumers, we remain responsible for foreseeable loss caused by our breach or failure to exercise reasonable care and skill where applicable law requires it. Nothing here removes statutory rights relating to paid digital content or services.

The service does not guarantee educational or commercial outcomes. Any responsibility for a particular loss depends on applicable law and the circumstances, not an unlimited disclaimer of our obligations.

20. Updates, governing law and contact

We may update these Terms for legal, security, operational or service changes. The date and version on this page identify the current Terms. Material changes affecting existing paid contracts will receive appropriate notice; updates do not retrospectively remove accrued rights.

These Terms are governed by the laws of England and Wales. Consumers elsewhere retain mandatory protections and court rights available under the laws that apply to them; this clause does not force an unlawful exclusive jurisdiction.

For service, licensing, cancellation or other questions, email hello@amberlylearning.com or write to Amberly Learning Ltd, 48 Queen Street, Exeter, EX4 3SR, United Kingdom.
